Acceptance of Our Terms and Conditions
Your continued use of Our Platform constitutes Your acceptance of these terms and conditions, including any additional terms that We may provide to You (“Terms”). These Terms are legally binding on You.
We are the flagship brand of STOCKLIFT SOLUTIONS PRIVATE LIMITED, offering Our Services to You wherein You can participate in various Contests hosted on Our Platform. Any person utilizing the Platform or any of its features, including participation in various Contests conducted on the Platform, shall be bound by the terms
In the event of any conflict between these Terms and additional terms related to the usage of Our Platform or any Contest, the additional terms shall prevail.
By accepting these Terms, You agree and consent to receive communications from Us and/or Our partners, licensors, or associates for any purpose through various channels, including but not limited to:
Announcements;
Administrative messages/direct messages;
Advertisements;
Direct notifications to Your account; and
Any other method deemed appropriate by Us.
To ensure proper delivery of these communications, You agree to mark Us as a safe sender on all platforms (including email and SMS) to prevent Our messages from being directed to spam or junk folders.
User Account
To access Our Services, You must register on Our Platform and create an account (“Account”). At the time of registration and throughout the usage of Our Services, You may be required to provide accurate and up-to-date information, including but not limited to:
Your full name;
Your team name;
Your mobile number;
Your full address and state of residence;
Your gender;
Your date of birth;
Aadhaar number;
Any other valid identification;
Bank account details;
UPI ID; and
Permanent Account Number (PAN).
We reserve the right to conduct Know Your Customer (KYC) verification as required by law or at Our discretion.
Eligibility
To participate in any Paid Contest, You must meet the following eligibility criteria:
Be at least 18 years old.
Reside in India.
Possess a valid Indian mobile number to create an Account.
Restricted States
Participation in Paid Contests is prohibited in the following states due to applicable laws and regulations:
Andhra Pradesh;
Assam;
Nagaland;
Sikkim; and
Telangana.
By accessing Paid Contests, You confirm that You do not reside in any of these Restricted States. You also agree not to provide false information, declarations, or representations to circumvent the applicable laws and regulations of these territories (“Applicable Law”).
CONTEST RULES AND FORMAT
Contest Rules
By participating in a Contest, You agree to the following terms and conditions:
Team Creation:
To participate, You must create a fantasy team (“Team”) by selecting real-life players from the specific Sport.
Teams must be finalized before the Contest start time or the adjusted time specified on the Platform (“Contest Deadline”). Any extensions to the Deadline will be communicated in advance.
Minimum Participants:
Each Contest requires a pre-specified minimum number of Users to activate and become operational (“Pre-specified Number of Users”).
Multiple Entries:
For multiple-entry contests, You may create and submit multiple Teams. The maximum number of Teams allowed per Contest format will be specified and may be restricted by Us at our sole discretion.
Participation Fees:
Participation in Paid Contests requires payment of a pre-designated amount as listed on the Contest page (“Pre-Designated Amount”).
Prize Money Pool:
A Prize Money Pool will be created from contributions made by all participating Users.
We have no ownership or interest in the Prize Money Pool.
A service fee (“Platform Fees”) will be deducted from the Pre-Designated Amount, with the remaining amount contributed to the Prize Money Pool.
Promotions and Offers:
Participation in promotions and offers organized by Us will be governed by the terms and conditions of the specific promotion/offer.
Participation Limits:
You may participate in up to 2,000 Contests per cricket match and 500 Contests per match for other sports.
A maximum of 20 Teams may be created per Contest.
Team Selection Assistance:
Features like toss and starting lineup information are provided as guidance to assist in Team selection.
Such features rely on third-party data feed providers and publicly available information.
Independent Research:
Before creating a Team, Users are advised to conduct independent research on player statistics, pitch conditions, weather, player performances, team history, and captain/vice-captain records.
Flexible and Non-Flexible Contests
Flexible Contests:
A Contest will be operational with a minimum of two Users joining.
Non-Flexible Contests:
A Contest will be operational only if the number of participating Users matches the set limit, as determined by Us for Public Contests or by You for Private Contests.
Prize Money Pool Adjustments:
For Flexible Contests, the Prize Money Pool is directly proportional to the number of participating Users.
In cases where the number of participants is less than the set limit, the Prize Money Pool will decrease proportionally.
Fantasy Rules:
Users must adhere to the applicable Fantasy Rules, detailed under "How to Play" sections for specific sports (e.g., Cricket, Football, Kabaddi, Basketball, etc.).
Additional Regulations:
Users must comply with all additional terms and regulations published by Us, including those related to participation fees and Contest operations.
CONTEST FORMATS
Public Contest
A Public Contest is open to all Users without restrictions.
Features of Public Contests:
Flexible and Non-Flexible Contests:
Public Contests can either be Flexible or Non-Flexible.
Cancellation:
We reserve the right to cancel a Public Contest if the number of participants is less than the Pre-Specified Number of Users. In such cases, the Pre-Designated Amount will be refunded in full without deduction.
Guaranteed Contests:
Guaranteed Contests become operational once the Pre-Specified Number of Users join.
The Prize Money Pool for Guaranteed Contests is predetermined, and We will cover any shortfall in the number of participants required to meet the guaranteed Prize Money Pool.
Winners will be declared as per the Contest page, irrespective of the number of participants.
Private Contest
A Private Contest is created by You, allowing You to invite other Users (“Invited Users”).
Features of Private Contests:
Creation:
Provide a name for the Private Contest.
Set a limit on participants (between 2–20,000 Users).
Choose whether the Contest will be Flexible or Non-Flexible.
Pay the Pre-Designated Amount to create the Contest.
Contest Code:
Upon creation, You will receive a unique identification code (“Contest Code”) to share with Invited Users.
Participation:
Invited Users must enter the Contest Code and pay the Pre-Designated Amount to join.
Refunds:
If the number of participants is less than the Pre-Specified Number for a Flexible Contest or the limit set by You for a Non-Flexible Contest, refunds will be processed after the Contest Deadline.
Restrictions:
Once created, You cannot modify the terms of the Private Contest.
We are not liable for any issues preventing Invited Users from joining the Contest.
WINNING
Winner Declaration
Teams earn points based on performance, and the Team with the highest score(s) wins (“Winners”).
In Contests with multiple Winners, prizes will be distributed in increasing order of aggregate Team scores.
Details of eligible winners and prizes will be provided on the Contest page before the Contest begins.
General Rules for Winnings Distribution
The User with the highest points wins a pre-designated prize from the Prize Money Pool.
In case of a tie, winnings will be evenly distributed among tied Winners.
We may modify winnings before the Contest Deadline.
All winnings are subject to specific promotional terms and conditions.
We reserve the right to disqualify any Winner for:
Providing false, incomplete, or misleading information.
Creating Teams on behalf of other Users.
Violating these Terms.
Entering from prohibited states.
Tabulation and Scoring
Scores and information are obtained from Data Feed Providers and official Sports Event websites.
Errors in scoring will be corrected before prize distribution, if brought to Our attention.
Verification of Winners
Winners will be contacted via email for document verification.
If unresolved issues arise, Winners must contact Help and Support within 48 hours of the declaration.
Our decision regarding Winnings is final and binding.
PAYMENT TERMS
Payment Accounts
Unutilized Account: Holds amounts deposited for participation.
Winning Account: Holds winnings from Paid Contests.
Discount Offers
Discounts, Discount Points, and Discount Bonuses may be issued at Our discretion and are subject to terms notified at issuance.
Discounts cannot be transferred or withdrawn to other accounts or bank accounts.
Discounts are applied towards the Pre-Designated Amount for Paid Contests.
Pre-Designated Amount Payment
Payment for joining Contests is debited first from the Unutilized Account, then the Winning Account.
If insufficient funds are available, additional payment may be required, inclusive of applicable GST.
Withdrawals Processing
First-time withdrawals require document verification.
Name on identification documents must match the name on the Account.
Payments are processed online and may take up to 24 hours.
Processing fees may apply for fund transfers.
TAXES PAYABLE
GST on Deposits
Effective from 1 October 2023, a 28% GST is applicable on all deposits made to your Unutilized Account.
You can view the GST paid on each deposit in the "My Transactions" section of the Platform.
The GST amount on the invoice shall be the final GST charged.
Tax Deducted at Source (TDS) on Winnings
All winnings are subject to TDS as per the Income Tax Act, 1961.
From 1 April 2023, a 30% TDS will be deducted from Net Winnings (NW) for every withdrawal request.
Calculation of Net Winnings (NW):
1. First Withdrawal in a Financial Year (FY):
NW = A - (B + C)
A = Total amount withdrawn from the Winning Account.
B = Total non-taxable deposits in the Unutilized Account till withdrawal.
C = Balance in the Unutilized and Winning Accounts at the start of the FY ("Opening Balance").
NW is zero if B + C ≥ A.
2. Subsequent Withdrawals in a FY:
NW = A - (B + C + E)
A = Total amount withdrawn from the Winning Account, including the current withdrawal.
B = Total non-taxable deposits in the Unutilized Account till withdrawal.
C = Opening Balance.
E = NW from earlier withdrawals if TDS was deducted.
NW is zero if B + C + E ≥ A.
3. End of FY:
NW = (A + D) - (B + C + E)
A = Total withdrawals from the Winning Account during the FY.
B = Total non-taxable deposits in the Unutilized Account during the FY.
C = Opening Balance.
D = Balance in the Unutilized and Winning Accounts at the end of the FY ("Closing Balance").
E = NW from earlier withdrawals if TDS was deducted.
NW is zero if B + C + E ≥ A + D.
Annual TDS Deduction:
If no withdrawals are made during a FY, 30% TDS will be deducted on the NW balance in your Winning Account as of 31 March.
Changes to TDS Rates:
If TDS rates or definitions of NW change as per government directives, deductions will align with the revised rules.
TDS Certificates:
TDS certificates will be provided for deductions.
Users are responsible for other applicable taxes, such as income tax or gift tax.
REFUNDS
Conditions for Refunds:
Refunds from your Unutilized Account will be processed if your account is suspended or removed due to:
Our inability to provide services.
Instructions from government or regulatory authorities.
Pre-Designated Amounts paid for a Contest will be refunded if the Contest is abandoned as per these Terms.
Account Deactivation:
If your account is deactivated due to instructions from authorities, deposits from the Unutilized Account will be refunded to the source account, subject to processing fees.
Force Majeure Events:
Refunds will be processed if a Contest is canceled due to circumstances beyond our control, including natural disasters, war, or other unforeseen events.
Paid Contests with Identical Teams:
For Paid Contests with up to 4 Users where all teams are identical:
Pre-Designated Amounts will be refunded after the match starts.
For contests with 5 or more Users with identical teams:
The Prize Money Pool will be equally divided among Users.
Refund of GST on Deposits:
Refund requests for Unutilized Account deposits will be processed net of GST (28%). GST will not be refunded as per applicable laws.
USER FUNDS
Third-Party Trustee Arrangement:
We may appoint a third party to hold and manage amounts on your behalf.
This arrangement ensures:
Deposits are solely for participating in Paid Contests.
Deposited amounts will not be forfeited, except by government instructions.
Bank Account Usage:
The non-interest-bearing account managed by the third party will handle:
Winnings withdrawals.
Payment of platform fees.
Tax payments, including GST and TDS.
YOUR CONDUCT
Account Information:
Each user may create only one account.
You must provide accurate and updated information during account creation or updates.
Providing false or impersonated information is prohibited and may result in account suspension or legal action.
Address Records:
Address details provided will be treated as your "Address on Record" under GST laws.
Responsibility to Update Details:
Promptly update your account details in case of changes or unauthorized account use by contacting our Help and Support team.
1. Maintaining Confidentiality
You must keep all account-related information confidential and must not share your One Time Password (OTP) with anyone.
Any attempt to fraudulently access another user’s account, including requesting their account details or OTP, is strictly prohibited.
2. Compliance with Applicable Laws
You must adhere to all applicable laws and regulations.
You must not engage in illegal activities that disrupt our systems.
3. Violations of Platform Terms
You are prohibited from engaging in any unfair play or activities that violate these terms.
Misusing discounts, offers, or promotions is not allowed.
You may only use the platform and services for personal purposes and must not engage in malpractice, collusion, or business activities via our platform.
Insider trading (e.g., sharing non-public information or using unfair advantages) is strictly prohibited.
Tampering, modifying, or interfering with our data, content, software, or intellectual property is forbidden.
4. Responsible Play
We encourage responsible gaming. Participate in contests responsibly, make informed decisions, and seek help if necessary.
5. Additional Features
Chat Feature:
Allows real-time communication in public or private settings.
You must refrain from illegal, obscene, abusive, defamatory, or offensive conduct.
Harassment, bullying, stalking, or threatening other users is prohibited.
All content you publish must comply with these terms and should not be immoral, profane, or misleading.
Commercial use of the platform, including advertising, requires prior written consent.
Spam, unsolicited communication, and collecting user information without consent are prohibited.
Activities threatening public order, national security, or friendly relations between nations are not allowed.
6. Our Rights and Obligations
Content:
We reserve the right to remove any content deemed offensive, illegal, or objectionable.
Contests:
Contest rosters, deadlines, or events may be revised, adjusted, or canceled due to unforeseen circumstances.
Contests may be abandoned or rescheduled in case of delays, weather conditions, or technical glitches.
Services:
We may change, suspend, or terminate services or user accounts based on regulatory directions or violations.
7. Intellectual Property Rights
All intellectual property, including software, content, and trademarks, is owned by us or our licensors.
You must not modify, reproduce, distribute, or exploit our intellectual property without permission.
By sharing content on our platform, you grant us a worldwide, non-exclusive, royalty-free license to use, distribute, and create derivative works from it.
8. Privacy Policy
Personal information collected is governed by our Privacy Policy. Review it to understand how data is collected and used.
9. Grievance Redressal Mechanism
Complaints about content or platform issues can be submitted to the Grievance Officer at grievanceofficer@FantasySportsLeagues.com.
The officer will address grievances per applicable laws. Complaints must be filed within 30 days of occurrence.
10. Legality
Fantasy sports on our platform are skill-based contests, legally protected, and do not constitute gambling or wagering.
11. Publicity
By accepting prizes, you grant us permission to use your name, likeness, and comments for promotional purposes.
12. Limitation of Liability and Indemnification
You agree to indemnify us and our representatives for any claims or damages arising from your use of the platform.
We are not liable for direct or indirect damages resulting from your use of our services.
13. Governing Law and Dispute Resolution
All disputes will be governed by the laws of India, with exclusive jurisdiction in Mumbai courts.
Disputes unresolved through discussions within 15 days will be settled through arbitration in Mumbai.
Interim relief may be sought to protect our interests during arbitration proceedings.
Other Terms
Governing Agreement
These Terms supersede all prior agreements between You and Us regarding the use of Our Platform and Services.
Non-Waiver
Our failure to enforce any provision or right under these Terms does not constitute a waiver of such provision or right.
Severability
If any provision of these Terms is deemed invalid, illegal, or unenforceable by a competent authority, the remaining provisions will remain in effect as long as they can be substantially performed.
Employee Restrictions
Our employees are not eligible to participate in paid Public Contests hosted on the Platform.
Additional Terms
You may be subject to additional terms governing transactions on the Platform. In the event of a conflict between these Terms and the additional terms, the latter will prevail.
Assignment of Rights
We reserve the right to assign or transfer Our rights and liabilities related to the Services to any entity at Our discretion.
Disclaimers
Force Majeure
We are not liable for delays or failure to provide Services due to events beyond Our control, including but not limited to natural disasters, technical failures, or government actions (“Force Majeure Events”).
Use at Your Own Risk
Access to Our Platform is at Your own risk. We are not liable for any loss, injury, death, or damage resulting from Your use of Our Platform.
Third-Party Content
Our Platform may include third-party advertisements or links to third-party websites and services.
We do not endorse or guarantee the accuracy, reliability, or quality of third-party content. Any reliance on such content is at Your own risk, and disputes must be resolved directly with the third party.
Data and Communication
We are not responsible for issues related to storage, deletion, delivery, or accessibility of information or materials, as allowed by law.
Errors, omissions, or miscommunications that prevent results or information from being conveyed to You are not Our responsibility.
No Warranties
All content on Our Platform is provided "as is" and "as available" without any warranty of accuracy or reliability.
We are not responsible for errors or inaccuracies in fantasy points calculations, team line-ups, or winner selection due to third-party information.
Prizes and Rewards
We make no representations regarding the quality, suitability, or merchantability of prizes and disclaim all liability related to them.
Technical Limitations
We are not liable for Your inability to access Our Platform due to factors beyond Our control, including network outages, internet disruptions, viruses, or malware.
We are not responsible for any consequences of You sharing confidential information, such as OTPs, with others
